武漢開發(fā)區(qū)建設(shè)協(xié)議書翻譯-中英對照
甲方: 功有限公司(Sing Kung Limited)
乙方: 華工程長春有限公司
甲方作為BT投資方獲得“產(chǎn)業(yè)園區(qū)城市基礎(chǔ)設(shè)施路（管）網(wǎng)工程BT模式投資建設(shè)”項(xiàng)目。乙方具備市政一級施工總承包資質(zhì)采用小BT方式與甲方合作進(jìn)行施工。為此，依照《中華人民共和國合同法》、《國務(wù)院關(guān)于投資體制改革的決定》及國家有關(guān)BT模式建設(shè)的政策、法律、法規(guī)，遵循平等、自愿、公平和誠實(shí)信用的原則，甲、乙雙方就本工程BT建設(shè)施工等事項(xiàng)協(xié)商一致，訂立本合同，雙方共同遵守。
一、項(xiàng)目概況
1、項(xiàng)目名稱：產(chǎn)業(yè)園區(qū)道路及其管網(wǎng)等基礎(chǔ)設(shè)施BT建設(shè)項(xiàng)目
2、項(xiàng)目地點(diǎn)：產(chǎn)業(yè)園區(qū)
3、項(xiàng)目內(nèi)容及范圍：石材產(chǎn)業(yè)園區(qū)城市基礎(chǔ)設(shè)施路（管）網(wǎng)工程BT模式投資建設(shè)項(xiàng)目的施工范圍包括吉林蛟河天崗石材產(chǎn)業(yè)園區(qū)道路及上、下水管網(wǎng)、橋涵、護(hù)坡及道路附屬工程等，具體以雙方商定的內(nèi)容為準(zhǔn)。
4、資金規(guī)模與來源：資金規(guī)模最終以工程結(jié)算為準(zhǔn)。甲乙雙方采用小BT模式建設(shè)。
二、合同工期和延誤責(zé)任
1、合同工期 自2007 年4月 15日開始，至 2008年 8月30日完成，其中每一條道路開工日期以施工許可證及開工報(bào)告時(shí)間為準(zhǔn)。
2、延誤責(zé)任 雙方約定，除因不可抗力外，如果2008 年8月30日乙方不能完成全部項(xiàng)目施工任務(wù)，導(dǎo)致甲方不能如約移交，乙方則無條件撒出該項(xiàng)目，同時(shí)甲方只向乙方支付實(shí)際施工款的10%，不承擔(dān)其它任何費(fèi)用，乙方也不另外索賠。因甲方材料款不按時(shí)到位而造成的工期延誤乙方不負(fù)責(zé)
三、工程款和計(jì)算辦法
1、工程款計(jì)算：首先，根據(jù)“吉林�。玻埃�6年市政工程定額”以及相關(guān)的配套文件和規(guī)定，把吉林市信息站公布的同期各種材料價(jià)格作為計(jì)價(jià)標(biāo)準(zhǔn)，依據(jù)施工圖紙和簽證工程量進(jìn)行計(jì)算，報(bào)經(jīng)甲方審核、并報(bào)經(jīng)政府部門進(jìn)行審計(jì)確認(rèn)后作為計(jì)價(jià)基數(shù)；然后，該計(jì)價(jià)基數(shù)的70%即是甲方回購乙方的工程價(jià)款。
除上述之外的其他部分，由甲方與政府另行結(jié)算，與乙方無關(guān)。
2、執(zhí)行“吉林�。玻埃�6年市政工程定額”時(shí)的原則：（1）“吉林省２００6年市政工程定額”中所列的各項(xiàng)均取，不進(jìn)行調(diào)整；（2）所列項(xiàng)中有上、下浮動(dòng)取值范圍的按最高值計(jì)��；（3）材料價(jià)格按施工期的吉林信息站公布的材料價(jià)格作為計(jì)算價(jià)；（4）如果某項(xiàng)材料不在信息站材料表之列，根據(jù)市場情況由信息站出具可信證明。

" project " that the project BT mode of the network is invested in the construction of that (in charge of ) of infrastructure way of industry's garden of stone material of hillock of day of Jiaohe River of Jilin that Party A gets as BT investor ". Party B possesses one grade of municipal administration and constructs and always contracts qualification and adopts small BT way and constructs by cooperating with Party A . For this reason, according to " contract law of the People's Republic of China " , " decision about the system reform of investment of the State Council " and national policy , laws and regulations about mode construction of BT, follow the equal , voluntary , fair and honest and trustworthy principle , both sides , on consensus that this project BT build the item of constructing etc., concluding a contract, both sides observe together.

3, project content and range: Infrastructure way of industry's garden of stone material of hillock of day of Jiaohe River of Jilin In charge of in the construction range of the project BT mode investment construction project of the network including road of industry's garden of stone material to the hillock on day of Jiaohe River of Jilin and had, enter the water in pipe network , bridges and culverts , the bank protection and subsidiary project of road ,etc. , is subject to content which both sides agree concretly.
