1 安裝保證條款

1.1 安裝承包商須保證機(jī)械供應(yīng)商提供的每一項(xiàng)貨品都按照其說明書以專業(yè)的方式安裝到位。

1.2 安裝承包商應(yīng)負(fù)責(zé)在24個(gè)月的安裝保證期內(nèi)準(zhǔn)確安裝，且安裝保證期從整個(gè)區(qū)域的機(jī)械竣工之日開始計(jì)算。

然而，如在安裝保證期內(nèi)遇到大修，安裝保證期則會(huì)略有延長(zhǎng)。

1.3 在安裝保證期內(nèi)，如須對(duì)設(shè)備的任何部件進(jìn)行修理或更換，可自修理或更換完成之日起，再次申請(qǐng)24個(gè)月的

保證期。

1.4 在安裝保證期內(nèi)，由于安裝材料使用不當(dāng)或工藝水平低下導(dǎo)致的不足，安裝承包商須自行承擔(dān)費(fèi)用將其更正

。

1.5 除非合同中另有規(guī)定，保證書將適用于由安裝承包商安裝的設(shè)備的所有部分。

1.6 T安裝承包商應(yīng)對(duì)分供方的履行情況負(fù)責(zé)，并視其為自己工作中的一部分。

1.7 如在合理的期限內(nèi)，安裝承包商無(wú)法履行其職責(zé)，買方將修理/更換因安裝不當(dāng)而導(dǎo)致的有缺陷的設(shè)備，且費(fèi)

用將由安裝承包商承擔(dān)。

2 保證期的終止

買方應(yīng)在安裝保證期滿前的至少30天內(nèi)，收到安裝承包商的書面通知。

除非收到該通知，任何保證都將有效。

在收到如是通知后，買方應(yīng)發(fā)放最終驗(yàn)收合格證。

1 QUALITY ASSURANCE

1.1 The Contractor shall within three months after the Effective Date of the Contract present the quality assurance

procedures of the Plant and the description of the quality assurance system used by the Contractor. The description shall include,

among others:

-organization and job description of the quality assurance system

-equipment used in inspections

-inspection methods and standards

-supervision of subcontractors and component suppliers

1.2 The description of the system as well as all inspection records, decisions on approval, material certificates, etc., related

to quality assurance shall be delivered to the Owner.

The following facts, shall be presented in the quality assurance description:

-liaison persons of the Contractor

-which subjects and operations are inspected in the workshop and alternatively at the erection site

-who shall carry out various inspections

-dates of inspections

-material certificates and other documentation

1.3 Records shall be kept of each inspection. The record shall include, among others, the following:

-name of the project and order number

-item of the inspection
-name of the inspector

-person in charge of  the inspection

-date
 
-inspection methods and inspection equipment

-noted deficiencies
 
-reference in the record to the repeat inspection in which the deficiencies have been stated to be remedied (to be marked

afterwards)

1.4 Inspection records and inspected pieces shall have sufficient markings by which the piece mentioned in the record can

be identified afterwards.

1.5  Records shall be kept of the painting work, covering such factors materially affecting the quality of the paint finish

such as the temperature and humidity of the painting site and in the painted object, drying times, etc.

2 INSPECTIONS

If inspections or tests are carried out at the workshop of the sub-contractor, the Contractor shall carefully prepare the agreed

inspection and expediting  visits of the Owner's inspectors and expeditors so that the involved persons as well as the documents

and equipment needed in the inspection and expediting are available and preliminary preparations for possible tests have been

carried out. The Contractor shall also provide free of charge such assistance, labour, materials, electricity, fuel, stores, apparatus

and instruments as may be reasonably demanded to carry out such inspections and tests efficiently. The costs of the Owner's

personnel shall be borne by the Owner.

3  FAILURE

The Owner shall be entitled during manufacture or erection of the Plant to inspect, expedite and witness tests, at the Contractor's 

subcontractor's workshops, regarding materials, equipment and workmanship of the Plant or any part of it and order stoppage  of

any manufacture or construction which results or would result in defects in the Plant. The Contractor or his subcontractor shall

discontinue such manufacture or construction, and shall expeditiously replace or repair any defective part of the Plant. Such

inspection by the Owner shall not release the Contractor from any obligations under the Contract.

4  OPERATING OF DEFECTIVE PLANT

If the Plant is not accepted in the inspection, or certain parts of it must be replaced, the Owner shall have the right, provided it

can be done without risks, to operate the Plant or the unaccepted parts without compensation to the Contractor until the defective

parts have been properly replaced.

 
5  PRESSURE VESSELS

5.1  Pressure vessel inspections shall be carried out in accordance with current Chinese legislation together with statutes

and standards connected to it. Documentation of each pressure vessel shall be supplied to the Owner, unless otherwise agreed

with the Owner.

5.2  The Contractor shall provide the Owner with the construction plan of each pressure vessel including the choice of

materials. The final documentation on each pressure vessel shall be supplied to the Owner before the Erection Inspection of the

vessel.
